Supreme Court Strikes Out CJ’s Affidavit.

The Supreme Court has unanimously dismissed a supplementary affidavit filed by suspended Chief Justice Gertrude Torkornoo, citing a breach of confidentiality requirements under Article 146 of Ghana’s Constitution.

The court’s decision was in response to an application by Deputy Attorney General Justice Srem Sai, who argued that the affidavit revealed sensitive information about ongoing impeachment proceedings.

Background to the Case Justice Torkornoo submitted the supplementary affidavit on May 26 in support of her request for an interlocutory injunction to halt the impeachment process against her. In the filing, she described her experience as deeply unjust, stating that the process amounted to “a mockery of justice, an assault on judicial independence, and worse than the treatment meted out to persons accused of treason.”

In the affidavit, Justice Torkornoo alleged that the impeachment process was unjust, violated her constitutional rights, and threatened judicial independence. She claimed procedural irregularities, including:

Refusal to recognize her legal counsel,Use of third-party witnesses,Denial of access to electronic devices,Intimidating proceedings at Osu Castle

Despite Justice Torkornoo’s claims, the Supreme Court struck out the affidavit, upholding the confidentiality requirements for impeachment proceedings.
